Article 1:

Scope and Modification of the General Terms and Conditions of Sale

These general terms and conditions of sale apply to all orders placed on the website www.duterneracingparts.com

The applicable GTC are those in effect on the day the order is validated.

Article 2:

Product Availability

Our product offers and prices are valid as long as they are visible on the site.

The photos are not contractual. Please contact us for more information.

Article 3:

Order Validation and Electronic Signature (law of March 13, 2000 on electronic signature)

Any order form signed by the consumer by “double click” constitutes an irrevocable acceptance which can only be challenged within the limits provided in these general terms and conditions of sale.

The “double click” associated with the authentication and non-repudiation procedure and the protection of the integrity of messages constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.

Article 4:

Payment Terms and Security

Payment Default

duterneracingparts.com reserves the right to refuse to make a delivery or fulfill an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.

Article 5:

Shipping and Delivery

All our packages are shipped in France by GLS and abroad by Colissimo. Delivery times are usually 2 to 5 business days from the processing date of your order.
However, if the delivery time proves to be longer, you will be automatically notified of the new deadline.

Upon delivery by GLS carrier:

– professional clients must affix their company stamp and signature on the delivery note

– individual clients must sign and note their ID card number, license, or passport on the delivery note.

In case of a dispute or non-delivery, no credit will be offered if these conditions are not met.

The client must verify in the presence of the delivery person that the package has not suffered damage or been opened. If it is found that the package has been damaged or opened, the client must make reservations with the delivery person and refuse the package. No credit will be issued for damages found after delivery.

Article 6:

Force Majeure

DUTERNERACINGPARTS cannot be held responsible for the non-performance of the concluded contract due to the occurrence of an event of force majeure.

Regarding products purchased to meet professional needs, duterneracingparts.com incurs no liability for any indirect damages, operational loss, loss of profit, damages, or expenses that may arise.

Article 7:

Withdrawal and Refund Policy

To properly process your request, please provide your order number and full contact details.

In accordance with the Hamon law of June 2014, you have a period of 14 working days from the delivery date of your order to return any item that does not suit you, in its original packaging and in good condition, suitable for resale, and request an exchange or refund without penalty, except for return shipping costs.

You can only return your order after requesting a return slip by mail. (to be attached with the return)

In case of an exchange (such as a sizing issue), a flat-rate fee of 12 euros including tax per package will be charged.

The refund will be made within a maximum of 15 days to your credit card, via your PayPal account, by check, or by transfer depending on the payment method used when ordering.

Article 8:

Warranties and After-Sales Service

General Information

All products sold by duterneracingparts.com are intended for use in motorcycle racing on closed circuits. Therefore, Duterneracingparts grants no warranty for these products.

Manufacturer’s Warranty

However, some products benefit from a Manufacturer’s Warranty. The duration of this warranty is displayed at the bottom of the product sheet. The warranty terms of the product will be indicated on the notice attached to it.

Article 9:

Disputes

Any dispute must be reported by email to the address contact@duterneracingparts.com

We will then contact you to resolve this issue in accordance with the Hamon law of March 17, 2014 (law number 2014 344)
